In order to further carry out legislative work such as the 2023 Securities and Futures Supervision Regulations, improve the legal implementation standard system for securities and futures supervision, strengthen the construction of market infrastructure, and promote the long-term, stable and healthy development of the capital market in accordance with the law, the China Securities Regulatory Commission recently formulated the 2023 annual legislative work plan. Overall arrangements were made for the legislative work throughout the year.
The first is to regulate the behavior of market entities and maintain the stable and healthy development of the capital market. Among them, there are 5 "key projects that we strive to launch within the year", including: formulating the "Measures for the Management of Business Qualifications of Securities Companies", "Measures for the Management of Securities Fund Investment Consulting Business", "Measures for the Management of Independent Directors of Listed Companies"; revising the "Measures for the Management of Pilot Stock Option Trading" 》《Information Technology Management Measures for Securities Fund Business Institutions》. There are 5 "projects that need to be studied and released at an appropriate time", including: the formulation of the "Interim Measures for the Supervision and Administration of Information Technology System Services in the Securities and Futures Industry" and the "Measures for the Delisting Management of Listed Companies"; the revision of the "Interim Measures for the Supervision and Administration of Private Equity Investment Funds" and the "Interim Measures for the Supervision and Administration of Listed Companies" Measures for the Administration of Corporate Information Disclosure" and "Measures for the Administration of Equity Incentives of Listed Companies".
The second is to implement the relevant requirements of the "Futures and Derivatives Law" and ensure the connection between the legal system, including three "key projects that we strive to introduce within the year", namely the revision of the "Measures for the Management of Futures Practitioners", "Measures for the Supervision and Management of Futures Companies", Futures Exchange Management Measures.
In addition to the above regulatory items, the China Securities Regulatory Commission will also cooperate with relevant departments of the State Council in the formulation and revision of administrative regulations such as the "Regulations on the Supervision and Administration of Listed Companies" and the "Regulations on the Supervision and Administration of Securities Companies" in 2023, and actively promote the "Regulations on the Administration of Real Estate Investment Trust Funds" 》Legislative work; cooperate with relevant judicial authorities to formulate and revise relevant judicial interpretations in the field of securities and futures.
